This is a Contract for Services between Tatumtech ("Booboot," "we," "us") and you (the "Courier") in connection with your use of the Booboot platform to find, negotiate, and complete delivery jobs. This Agreement, together with the Confidentiality & Data Handling Policy, forms the complete agreement between you and Tatumtech for this role.
1. Independent Contractor Status
You are engaged as an independent contractor providing delivery services under this Contract for Services. You are not an employee, agent, partner, or representative of Tatumtech, and nothing in this Agreement creates an employment relationship. As an independent contractor, you are not entitled to employee benefits including but not limited to EPF, SOCSO's employment injury scheme, paid annual leave, sick leave, or any other statutory employment benefit that applies specifically to employees under Malaysian employment law. You are responsible for your own tax obligations, including declaring any income earned through Booboot to Lembaga Hasil Dalam Negeri (LHDN) as required by law. This Agreement is a service agreement under the Gig Workers Act 2025, not an employment contract.
2. Nature of Services
You use the Booboot app to browse delivery jobs posted by requesters, negotiate a price directly with the requester through in-app chat, and complete deliveries you accept. You decide which jobs to accept, when to be available, and how many jobs to take on at a time, subject to the app's active-job limit. Booboot does not assign jobs to you, set your schedule, or direct how you carry out a delivery. Booboot verifies your identity only. You are solely responsible for holding and keeping valid every licence, road tax, insurance, permit and other document that the law requires for the vehicle you use and the delivery work you do, and for complying with all road and transport laws.
3. Earnings and Payment
Payment for each completed job is made directly to you by the requester — by DuitNow, bank transfer, or another method you and the requester agree on in chat. Tatumtech does not process, hold, or guarantee this payment, and is not a party to the price you negotiate. If a requester fails to pay you for a completed job, this is a dispute between you and that requester; you may report it through the app's dispute process (see Section 8), but Tatumtech is not responsible for collecting or reimbursing the payment on your behalf. You keep 100% of what you earn from each delivery — Tatumtech does not take a commission on job earnings. If you were referred to Booboot using another courier's referral code, that courier may earn a separate commission from Tatumtech based on your subscription; this has no effect on your own earnings and is never deducted from what a requester pays you.
4. Subscription
To stay active on the platform, you subscribe to Booboot at the rate and duration shown in the app at the time you subscribe. This is the only payment you make to Tatumtech. A lapsed subscription means you cannot go online or accept new jobs until you renew, but does not itself affect your registration or profile.
5. Self-Employment Social Security Scheme (SKSPS)
Under the Gig Workers Act 2025, delivery riders are required to register under PERKESO's Self-Employment Social Security Scheme (SKSPS), available at matrix.perkeso.gov.my. Registering, maintaining your registration, and making any required contributions is your own responsibility as an independent contractor — Tatumtech does not register you, hold your SKSPS credentials, or make contributions on your behalf. You confirmed your understanding of this requirement when you signed up. Failing to register may also carry its own separate legal consequences under the Self-Employment Social Security Act 2017, independent of this Agreement.
6. Freedom to Work Elsewhere
Nothing in this Agreement restricts your right to also work for other delivery platforms, ride-hailing services, or any other business, at the same time as using Booboot. Tatumtech will never require exclusivity as a condition of your account.
7. Suspension and Deactivation
Tatumtech may suspend or deactivate your account for just cause — including breach of this Agreement, breach of the Confidentiality & Data Handling Policy, fraud, repeated policy violations, or conduct that harms Booboot, other users, or Tatumtech's reputation. Where practical, you will be told the reason for a suspension or deactivation. Where deactivation follows the terms of this Agreement, your access ends within 7 days. You may stop using Booboot at any time yourself, with no obligation to give notice.
8. Disputes
If you have a complaint — about a requester, another courier, a payment issue, or a decision Tatumtech has made about your account — you can raise it through the in-app dispute process; this is Booboot's internal grievance mechanism. If your complaint isn't resolved within 30 days, or you're unhappy with the outcome, the Gig Workers Act 2025 gives you the right to bring the matter to the Director General for Industrial Relations (acting as Conciliator), and from there, if unresolved, to the Gig Workers Tribunal. Using Booboot's internal process first does not require you to give up this right.
9. Occupational Safety
You are responsible for your own vehicle, safety equipment, and compliance with Malaysian road traffic law while making deliveries. Booboot's in-app courier training material includes safety guidance, which you should read and follow. Report any safety concern about the platform itself — not road conditions or traffic — through the in-app dispute process.
10. Confidentiality and Data Handling
In using Booboot you may see personal information belonging to requesters or other couriers — such as a name, phone number, or delivery address — in the course of completing a job. This information must only be used to complete that job, and must never be shared, copied, or used for any other purpose, including moving the conversation to WhatsApp or contacting a requester outside the app. Full detail is set out in the Confidentiality & Data Handling Policy, which forms part of this Agreement.
11. No Authority to Bind Booboot
You have no authority to make representations, sign agreements, incur obligations, or speak publicly on behalf of Tatumtech.
12. Limitation of Liability
To the maximum extent permitted by law, Tatumtech is not liable for a requester's failure to pay you, for losses arising from your use of your own vehicle, or for indirect, incidental, or consequential losses arising from your use of Booboot.
13. Governing Law
This Agreement is governed by the laws of Malaysia, including the Gig Workers Act 2025. Any term of this Agreement that is less favourable to you than what that Act requires is void and is replaced by the Act's own minimum protections.
14. Changes to This Agreement
Tatumtech may update this Agreement from time to time. Continued use of Booboot after an update means you accept the revised Agreement. Material changes will be communicated to you where practicable.
